1. Scope of Application

1.1 These General Terms and Conditions (hereinafter "GTC") of FliesenKurier (hereinafter "Seller") apply to all contracts concluded by a consumer or entrepreneur (hereinafter "Customer") with the Seller regarding goods and/or services displayed by the Seller on the online trading platform www.FliesenKurier.com. The inclusion of the Customer's own terms and conditions is hereby objected to, unless otherwise agreed.

1.2 A consumer within the meaning of these GTC is any natural person who concludes a legal transaction for purposes that are predominantly neither commercial nor their independent professional activity. An entrepreneur within the meaning of these GTC is any natural or legal person or a partnership with legal capacity who, when concluding a legal transaction, acts in the exercise of their independent professional or commercial activity.

2. Conclusion of Contract

2.1 The conclusion of contracts at FliesenKurier.com is governed by Section 6 of the General Terms and Conditions for the use of the German-language services.

2.2 Only the German language is available for the conclusion of the contract.

4. Prices and Payment Terms

4.1 The prices stated by the Seller are final prices (package and pallet) and include the statutory value-added tax. Any additional delivery and shipping costs will be stated separately in the respective product description.

4.2 The Customer has various payment options available, which are indicated on the respective offer page of the Seller on eBay.

5 Delivery, Shipping Costs and Transfer of Risk

5.1 Goods are delivered by mail to the delivery address specified by the Customer, including a contact person with a telephone number, unless otherwise agreed. For the processing of the transaction, the delivery address stored by the Customer on eBay is decisive.

5.2 Delivery is made at the shipping costs stated in the respective offer. If the Customer is a consumer, we bear the shipping risk in any case, regardless of the shipping method. If the Customer is an entrepreneur, all risks and dangers of shipment pass to the Customer as soon as the goods have been handed over by us to the commissioned logistics partner.

6. Retention of Title

The delivered goods remain our property until full payment of the purchase price.

7. Liability for Defects

Statutory liability for defects applies. Complaints and claims for defects can be submitted to the address provided in the imprint.

8. Applicable Law

The law of the Federal Republic of Germany applies to the contractual relationship between us and the Customer, as well as to the respective terms and conditions. If the Customer is a consumer, the statutory regulations and rights protecting the consumer, which apply under the law of the state in which the consumer has their habitual residence and from which no deviation can be made by agreement, remain unaffected by this agreement. The application of UN sales law is excluded.
